This guide clarifies the Department of Transportation's (DOT) Substance Abuse Professional (SAP) program for CDL drivers who violated drug and alcohol testing regulations.
Understanding the Process
The SAP program establishes a formal return-to-duty protocol, with key steps:
Driver Selects a Qualified SAP: You choose a DOT-approved professional.
Initial Evaluation: The SAP assesses your situation.
Education/Treatment Recommendations: Based on the evaluation, the SAP recommends educational or treatment programs.
Follow-Up Evaluation: Upon completing the recommendations, you return for a follow-up review.
Return-to-Duty Test Eligibility: The SAP determines your eligibility for a return-to-duty drug test.
Return-to-Duty Testing: The employer administers a drug and alcohol test.
Potential Return to Duty: Upon negative results, your employer may reinstate safety-sensitive duties.

The DOT SAP has specific reporting responsibilities regarding the Clearinghouse:
Initial Assessment: After the initial evaluation with the driver, the SAP must report the completion date to the Clearinghouse by the close of the next business day.
Return-to-Duty (RTD) Eligibility: Once the driver finishes the recommended education/treatment and is deemed eligible for RTD testing, the SAP again reports this date to the Clearinghouse within the same timeframe (close of next business day).
In simpler terms, the SAP acts as a data reporter for the Clearinghouse system (for FMCSA-covered employees, not FFA-covered, for example), documenting key milestones in the driver's return-to-duty process.
There's no federal law mandating who pays for the DOT SAP program. The responsibility falls on either the driver or the employer, depending on the company's policy. Here's a breakdown:
Employer: Some companies choose to cover the cost of the SAP program for their employees. This can be a good incentive for drivers to participate in the program swiftly.
Employee: In most cases, the responsibility falls on the employee themself. This includes the initial evaluation, recommended education/treatment programs, and any associated fees from the SAP.
It's crucial to check your employer's policy or handbook to determine who shoulders the cost in your situation.
